गुजरात उच्च न्यायालय के दो विधिवेत्ताओं--श्री मेहता एवं श्री सेठ--की artis
ने दिया था। उस विस्तृत फैसले से अखबारी स्वतंत्रता का सही अर्थ समझा जा
सकता है। एक के बाद एक दिए जा रहे प्रतिकूल फैसलों से झुँहलाकर सरकार ने
न्यायमूर्तियों के तबादलों का रास्ता अपनाया। इन मनमाने तबादलों का शिकार हुए
देश भर के चौदह न्यायाधीशों में गुजरात के सर्वश्री बी.जे. दीवान, टी.यू. मेहता
तथा साकलचंद सेठ भी थे। न्यायमूर्ति श्री सेठ ने सरकार की बदले की भावना से
प्रेरित होकर की गई इस काररवाई को अदालत में चुनौती दी। इस अदालती संघर्ष
में श्री सिरवई ने सहायता की थी।
बरेली aris ने लंबी सुनवाई के बाद न्यायमूर्ति सर्वश्री जे.बी. मेहता,
न्यायमूर्ति ए.डी. देसाई एवं न्यायमूर्ति डी.ए. देसाई को स्थानांतरित करने के राष्ट्रपति
के आदेश को संविधान-सम्मत न मानते हुए उस आदेश को निरस्त कर दिया और
इस प्रकार न्यायपालिका की स्वतंत्रता को बरकरार रखा गया।

कीमत पर संघर्ष करने के लिए कटिबद्ध थे। गुजरात उच्च न्यायालय बार एसोसिएशन
द्वारा उनके लिए आयोजित विदाई समारोह में उन्होंने साफ शब्दों में कहा था, “ मेरा
तबादला चाहे कहीं भी किया जाए, हो सकता है कि मुझे न्यायाधीश के पद से भी
हटा दिया जाए; किंतु फिर भी मैं न्यायपालिका को गुलामी से बचाए रखने के लिए
हमेशा कोशिश करता रहूँगा।'
