याचिका को काररवाई के लिए स्वीकार कर लिया। अदालत का रुख देख सेंसर
विभाग ने अपना आदेश निरस्त कर दिया और यह लेख १५ अगस्त, १९७५ के
*साधना' के अंक में प्रकाशित हुआ, जिसे बहुत से लोगों ने पढ़ा था।
२५ अगस्त के दिन लोक संघर्ष समिति के कार्यकर्ताओं ने सेंसर प्राधिकरण
कार्यालय के सामने “मुक्त नागरिक-पत्र' का पाठ किया। इस पत्रिका पर मुद्रक,
प्रकाशक और संपादक के नामों के स्थान पर सभी ने अपना-अपना नाम लिखा था,
अत: सभी को गिरफ्तार कर लिया गया था। मेट्रोपोलिटन मजिस्ट्रेट श्री एस.बी.
बोरा ने सभी सत्याग्रहियों को निर्दोष घोषित कर मुक्त करते हुए अपने फैसले में
सरकार की आलोचना करते हुए कहा था, 'अधिनियमों के प्रावधानों का यदि इस
प्रकार मनमाना उपयोग किया जाएगा तो कानून में निहित न्याय के मूलभूत उद्देश्य
की ही हत्या हो जाएगी। 'सविनय कानून भंग' का सिद्धांत तो महात्माजी द्वारा इस
देश को मिली एक अप्रतिम विरासत है। पत्रिका पठन के इस कार्यक्रम का यदि
यही प्रतीकार्थ है तो इस कार्यक्रम को गैर-कानूनी मानने को यह अदालत कतई
तैयार नहीं है। देश में जब तक लोकतंत्र बना हुआ है तब तक व्यक्तिवादिता का
कोई स्थान नहीं है। व्यक्ति तो नाशवान् है, किंतु देश का लोकतंत्र अमर है और
लोकतांत्रिक सरकार ही अजर-अमर है।'
राजकोट के न्यायमूर्ति ने ४ नवंबर, १९७५ को दिए गए अपने एक फैसले
में कहा था कि “स्वतंत्रता का जतन करने और देश की आंतरिक सुरक्षा को हानिन
पहुँचे, इस बात की सावधानी रखना हर एक भारतीय का परम कर्तव्य है; किंतु
इसका यह अर्थ कतई नहीं है कि सरकार के किसी निर्णय की उचित आलोचना या
विरोध न किया जा सके।'
