संघर्ष में बुद्धिजीवियों की भूमिका
आपातकाल के लोकतंत्र बचाओ संघर्ष में गुजरात के न््याय-तंत्र ने भी
अपनी अनूठी भूमिका निभाई et देश भर में डी.आई.आर. के तहत पकड़े जानेवाले
कार्यकर्ताओं की जमानत किसी हालत में स्वीकार नहीं होती थी, जबकि गुजरात में
उस दौरान पकड़े गए राष्ट्रीय स्वयंसेवक संघ एवं अन्य प्रतिबंधित संगठनों के
कार्यकर्ताओं की जमानतें तत्काल मंजूर कर दी गई थीं। अदालती काररवाई के बाद
इन सभी कार्यकर्ताओं को निर्दोष घोषित कर मुक्त कर दिया गया था। संघ पर
प्रतिबंध लगाने के बाद संघ के गुजरात मुख्यालय को सरकार ने जब्त कर लिया
था। यह स्थल ' डॉ. हेडगेवार स्मारक समिति ' की संपत्ति था, अत: ट्रस्ट के अध्यक्ष
श्री विश्वनाथ वणीकर ने अपनी संपत्ति पुनः प्राप्त करने के लिए अदालत में
आवेदन किया। विद्वान् न्यायमूर्ति श्री दामाणी ने सुनवाई के बाद सरकार की
अधिग्रहण काररवाई को अनुचित घोषित कर यह आदेश दिया कि मकान का कब्जा
ट्रस्ट को लौटा दिया जाए। प्रतिबंधित संस्था 'जमाअत-ए-इसलामी ' ने गुजरात
उच्च न्यायालय में संस्था पर लादे गए प्रतिबंध के खिलाफ एक याचिका दायर की,
जिसकी सुनवाई के लिए अदालत ने अनुमति दी थी।
२६ जुलाई को अहमदाबाद के नारणपुरा इलाके में आयोजित एक सार्वजनिक
सभा को संबोधित करनेवाले saat पर पुलिस ने सरकार के खिलाफ लोगों को
भड़काने का आरोप लगाया था; किंतु faery न्यायमूर्ति श्री दामाणी ने वक््ताओं को
निर्दोष मानते हुए अपना निर्णय-द्िया था कि 'जनता शांतिपूर्ण आंदोलन के माध्यम
