*गुजरात हाई कोर्ट एडवोकेट एसोसिएशन' की १८ अक्तूबर, १९७५ को
आयोजित बैठक में प्रसिद्ध विधिवेत्ता श्री चंद्रकांत दरु ने श्री बी.बी. पटेल के
सहयोग से आपातस्थिति तथा तत्संबंधित संविधान संशोधनों के विरोध में एक
प्रस्ताव प्रस्तुत किया, जो कि सर्वानुमति से पारित किया गया। प्रस्ताव में कहा गया
कि 'इस सभा की जानकारी के अनुसार, भारत के संविधान में जिन संशोधनों के
बारे में सरकार सोच रही है, उनसे आम जनता के अधिकारों पर प्रतिकूल प्रभाव
पड़ेगा। यह सभा इन संशोधनों की सुसंगतता, योग्यता तथा औचित्य के बारे में
अपने प्रतिभाव व्यक्त करने का अपना अधिकार सरकार द्वारा विधिवत् इन संशोधनों
को विचार हेतु प्रस्तुत किए जाने तक स्थगित रखती है। फिर भी, एसोसिएशन
दृढ़तापूर्वक यह मानता है कि ऐसे संशोधनों के बारे में राजनीतिक व अन्य क्षेत्रों के
विशेषज्ञों, कुशंल वकीलों, संसदीय मामलों के विशेषज्ञों तथा विपक्षीय नेताओं की
राय जाने बगैर संशोधन पारित करने की दिशा में आगे नहीं बढ़ना चाहिए। कानून
के लोकतंत्र-सम्मत अमलीकरण के लिए ऐसा होना अत्यंत आवश्यक है।
“यह मंडल पुन: अपना मंतव्य व्यक्त करता है कि लोकतांत्रिक प्रक्रिया को
प्रभावी ढंग से चलाने के लिए अत्यंत आवश्यक है कि संविधान में किसी भी प्रकार
के संशोधन से पहले प्रजा तत्संबंधित अपने अभिप्राय स्वतंत्रतापूर्वक व्यक्त कर
सके। संबंधित लोगों से भी इस विषय में चर्चा होनी चाहिए।'
विधिविदों की तरह ही गुजरात के शिक्षाविदों ने भी लोकतंत्र पक्षी इस
लड़ाई में अपना यथासंभव योगदान दिया था। गुजरात की प्राथमिक, माध्यमिक
शालाओं के शिक्षक, प्राध्यापक व आचार्यों के संयुक्त प्रयासों से १ फरवरी, १९७६
के दिन अहमदाबाद में गुजरात यूनिवर्सिटी के सीनेट हॉल में आयोजित एक
सम्मेलन में गुजरात भर के शिक्षाविदों ने हिस्सा लिया था। इन शिक्षाविदों के
सामूहिक प्रयत्नों से इस सम्मेलन में “विद्यागुर्जरी ' नामक संस्था गठित की गई।
